Due to the accession of the Republic of Poland to the European Union, the current freight tariff of PKP Cargo SA has become the sole freight tariff applied by the national railway carrier when selling transport services, regardless of the type of transport, domestic or international, including transit through the territory of Poland. In accordance with the provisions of Article 4(1) of EEC Council Regulation No. 11/60 on the abolition of discrimination in transport rates and conditions, it is not possible for a single railway carrier to apply different tariffs within the European Community.
The new PKP Cargo SA tariff, organized into four chapters, includes general and specific tariff provisions, tables of basic charges and adjustment factors, and additional fees. The Harmonized Commodity Code (NHM) is published separately. The tariff has been slightly simplified and modified. Some legal and transport-related provisions have been appropriately moved to the
Regulations for the Carriage of Freight Shipments (RPT). The new tariff has a unified, higher level of charges, although various tariff discounts and reductions have been provided. The general provisions of the tariff (§ 1) define it, indicating that it specifies prices and the rules for their determination for the carriage of goods and additional services, and serves as the basis for their collection in accordance with the Rules for the sale of freight transport services by PKP Cargo SA in 2004.
The PKP Cargo SA freight tariff is applied to the carriage of freight shipments (the term “wagonload” is no longer used) transported on the basis of national transport law (domestic shipment) and international railway transport law CIM and SMGS (international shipment). The entry into force of the tariff, its amendments, and its repeal are announced in the promulgation organ “Biuletyn PKP Cargo SA” and on the website “www.pkp-cargo.pl”. The tariff continues to define the legal and transport concept of a shipment, which consists of goods accepted for carriage on the basis of a single consignment note, loaded into one or more wagons, rolling stock moving on its own wheels, and empty wagons marked with a “P” or “W”. Depending on the length of the delivery time, shipments are divided into ordinary shipments and shipments with a contractual delivery time. Meanwhile, provisions regarding the determination of the delivery time for freight shipments have been moved to the RPT regulations.
