E-consumer rights – part 2

In the previous issue of “e-Fakty” we presented the first six articles of the European Code of Conduct, according to which electronic stores applying for the Euro-Label certificate are verified. Each article was described in relation to its practical application, along with a reference to Polish legislation. In this issue, we present the last six articles of the Code.
Article 7. Right of return.
A consumer making a purchase in an online store has – apart from justified exceptions – an inalienable right to return goods that show no signs of use within a specified period from the date of product delivery. The European Union recommends a 14-day period, however, the time allowed for the consumer to make a return varies across different member states. Furthermore, the consumer is entitled to an extension of the aforementioned period to 3 months if the seller has not attached to the delivered goods the “confirmation of information” required by Article 9, paragraph 1 of the Act of March 2, 2000, on the protection of certain consumer rights and liability for damage caused by a dangerous product.
Article 8. Money-back guarantee.
The refund for an unfulfilled contract should take place “immediately, but no later than within thirty days from the conclusion of the contract”. In the event that an order cannot be fulfilled, the store should make a refund no later than on the 30th day from the date of the contract’s conclusion. If the customer has made a prepayment for the goods, the store should return the received amount. Additionally, the Civil Code indicates that this amount should be increased by interest for delay.
The article comes from the magazine “e-Fakty” 5/2006.
