Natural losses in transport – a problem requiring regulation

Knowledge of legal regulations in the fields of purchasing, sales, and warehousing by the relevant departments is a significant factor ensuring operational efficiency and effectiveness.
In business practice, knowledge in this area is not optimal, which is why publications addressing these issues are very useful, as they help in properly resolving disputes in contacts between suppliers, recipients, and transport and forwarding companies.
It is therefore fortunate that the editorial board of “Logistyka” recognized the importance of this issue by publishing in issue 6/2004 an article by J. Kopyt and G. Krawiec titled “Liability of the carrier and forwarder for loss, shortage, or damage to the shipment,” which discusses these issues based on the provisions of the Civil Code.
In my opinion, this topic requires supplementation with the current legal status regarding the application of natural losses in transport. This stems primarily from the fact that a certain legal loophole has emerged in this area, which requires urgent removal and formal regulation. A number of legal acts are no longer in force, and others have not been amended. It therefore seems justified to define the essence of these changes and to provide the currently applicable regulations. In recent years, along with changes in the national economy, the existing regulations concerning standards for natural losses have also changed.
The article comes from the magazine “Logistyka” no. 2/2005.
