Complaints in an e-shop

The first step to take when you want to make online purchases is to review their offers using a so-called “comparison engine”. This is a service that online stores cooperate with by sending their offers to it. This is how the comparison engine knows what the offers look like (usually updated daily) and selects products based on this. The most frequently visited Polish websites comparing online store offers are Gemino.pl, 9sekund.pl, or Skapiec.pl. There, by setting criteria (brand, technical data,
price), we receive an up-to-date list of prices for the item we are looking for. A quick and effective method that allows us to save long hours of running from store to store. You can also simply type the product name into a search engine. Some links provided by the search engine, purchased by online stores, will direct us to the appropriate seller. The second step is, of course, placing an order and making the payment. It is worth adding that the seller is obliged to provide their contact details
(name, address, registered office, registration data) before the transaction. Contrary to appearances, this is not a trivial requirement, because a seller’s website with a fictitious offer may contain only an account number and an e-mail address, and this should make us think. Next, the store is obliged to provide the full price of the offered product, including the costs of any taxes, duties, etc. The seller is also obliged to fully and clearly inform us about the total costs, time, and method of delivery of the goods. And most importantly – they should inform us about the complaint procedure and its conditions. The problem arises when we are not satisfied with the purchased
item, we do not like it, or it is damaged. In the first case, we can use the rights that customers of online stores are entitled to, included in the Act of March 2, 2000, on the protection of certain consumer rights and liability for damage caused by a dangerous product. It ensures us the possibility of resigning from the purchase within ten days of the ordered item being delivered to our home. The contract between the customer and the seller is considered not concluded. This releases the buyer from all obligations; the requirement is only to return the product in an unchanged state (therefore, you cannot use it for ten days and then try to return it, but you can try it out, i.e., try it on, check how it works). Wanting to resign from the purchased
product, we must draw up a written resignation and send it to the seller within ten days, and return the goods immediately, but no later than within two weeks. If all the required, previously detailed information about the name, registered office of the store, price, as well as the right to withdraw from the contract within ten days has not been provided on the online store’s website, then the period in which you can resign from the purchase is three months.
